Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 39 feet 11 inches [12.17 metres].

It should be understood that these insertions are not part of the original text.
Any errors in these conversions are my responsibility.

The Governor in Council on the report and recommendation of the Minister of Finance dated January 20, 1997 pursuant to Section 4 of Chapter 351 of the Revised Statutes of Nova Scotia, 1989, the Nova Scotia Power Finance Corporation Act, is pleased to:
      (a) accept the resignation and revoke the appointment of James A. Power, C.A., as a member of the Board of Directors of Nova Scotia Power Finance Corporation, effective May 31, 1996, which appointment was made by Order in Council 95-602 dated August 9, 1995;
      (b) accept the resignation and revoke the appointment of C.H. The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated January 30, 1997, pursuant to subclause 7(1)(b)(ii) and subsection 7(2) of Chapter 5 of the Statutes of Nova Scotia 1994, the Economic Renewal Act, is pleased to:
      (a) authorize the Minister responsible for the Nova Scotia Economic Renewal Agency to enter into an Agreement with the Hanse Society, a non-profit society with its head office at Annapolis Royal, Annapolis County, for the purpose of leasing and providing an option to purchase the lands, premises and equipment at the Upper Clements Park substantially upon the terms and conditions contained in the draft Lease which is attached to the report and recommendation as Schedule "A" with such changes thereto as the Minister may deem necessary; and
      (b) authorize the Minister to execute the Lease and any other deeds or instruments required pursuant to the terms and conditions of the Lease in accordance with this order, whether the Lease is executed before or after the date of this Order.

Hayes as a member and Chair of the Halifax-Dartmouth Port Development Commission on behalf of the Halifax Regional Municipality for a term of office commencing February 1, 1997, and ending December 31, 1999.

The Governor in Council on the report and recommendation of the Acting Minister of Transportation and Public Works dated January 23, 1997, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 0.15 acre [607 square metres], more or less, situate at or near Mira, Cape Breton Regional Municipality, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", both Schedules being attached to and forming part of the report and recommendation;
      (b) convey the said lands to Gordon W. MacDonald of Marion Bridge, Cape Breton Regional Municipality, for the price of $300.00; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Acting Minister of Transportation and Public Works dated January 23, 1997, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 1,413 square metres, more or less, situate at or near West Wentworth, Cumberland County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", both Schedules being attached to and forming part of the report and recommendation;
      (b) convey the said lands to Donald F. Sweete of Bedford, Halifax Regional Municipality, for the price of $573.90; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated January 15, 1997, pursuant to subsection 37(1) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve Petition No. 35691 and to authorize the Minister of Natural Resources to issue a certificate, in the form set forth in Schedule "A" attached to and forming part of the report and recommendation, to the effect that the Crown asserts no interest or claim in or to those lands, containing about 0.5 acre [2020 square metres], situate at East Dover, Halifax Regional Municipality, which are more particularly described and shown cross-hatched on the plan contained in the said Schedule "A".

      (d) provide that the Province will defend, negotiate or settle claims made against, and indemnify from personal liability for, a person appointed to an appeal panel provided that the Province is satisfied that the claim arises out of the person's activities in relation to the appointment and is not based on fraud or criminal activity, and provided that the Province will be in control of a case which it defends.

The Governor in Council on the report and recommendation of the Acting Minister responsible for the Nova Scotia Economic Renewal Agency dated December 12, 1996, pursuant to Sections 2, 3 and 4 of Chapter 222 of the Revised Statutes of Nova Scotia, 1989, the Industrial Development Act, is pleased to:
      (a) authorize financial assistance to Phonettix Intelecom Ltd. in an amount not to exceed Three Million Five Hundred Thousand Dollars ($3,500,000.00) on the terms and conditions outlined in Schedule "A" attached to and forming part of the report and recommendation;
      (b) charge to the Free Balance of the Industrial Expansion Fund the sum of Three Million Five Hundred Thousand Dollars ($3,500,000.00) for the proposed financial assistance;
      (c) authorize the Nova Scotia Business Development Corporation to execute such agreements and instruments as may be required to give effect to this Order.

Whereas the remuneration of the Chairperson of the Review Board under the Criminal Code at $38,000.00 per year is substantially lower than the remuneration of $55,600.00 provided to the Chairperson in 1994/95, and whereas the remuneration of $38,000.00 per year does not adequately reimburse the Chairperson for work performed, the Governor in Council on the report and recommendation of the Minister of Justice dated December 10, 1996, pursuant to Section 672.36 of Chapter C-46 of the Revised Statutes of Canada, 1985, the Criminal Code, is pleased:
      (a) to amend Order in Council 96-72 dated January 31, 1996:

(1) by striking out "$3,300.00" in the second line of clause (f) and substituting "$4,500.00", effective February 11, 1997; and
(2) by adding the following clause immediately following clause (f) thereof:

(g) determine that the Province shall defend, negotiate or settle claims or charges made against a member or members of the Review Board and indemnify them from personal liability provided, however, the Province is satisfied that the claim arises out of the member's activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends."; and

      (b) to amend Order in Council 96-175, dated March 26, 1996, by adding, immediately following the word "hour" in the last line thereof, "and determine that the Province shall defend, negotiate or settle claims or charges made against Pam Cook and indemnify her from personal liability provided, however, the Province is satisfied that the claim arises out of her activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends.".

      The Minister of Finance therefore recommends that pursuant to Section 27A of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, that the right to commit the appropriations listed in Column I of Part A be suspended in the amounts set out in Column II of Part A for the fiscal year ending March 31, 1997.
      The Minister of Finance further recommends that pursuant to Section 28 of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, the additional sums set out in Column II of Part B be appropriated to the service for which appropriation has been made for the fiscal year ending March 31, 1997.
      The Governor in Council is pleased to approve of the Report and Recommendation and to order in accordance therewith.

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs dated January 30, 1997, pursuant to Section 17 of Chapter 406 of the Statutes of Nova Scotia, 1989, the Rural Fire District Act, is pleased to:
      (a) declare by proclamation in the Royal Gazette, Part II that effective February 15, 1997, the area described in paragraph (d) below shall be a fire protection district and that the Rural Fire District Act shall apply to the area;
      (b) prescribe the name of the district to be the Little Dover Fire Protection District;
      (c) declare that the commissioners hereinafter appointed and their successors in office shall be a body corporate under the name and title of "The Fire Protection Commissioners for the District of Little Dover";
      (d) define the boundaries of the Little Dover Fire Protection District as follows: Beginning at Basin Lake, where the brook crosses Dover Road, flowing south-southwesterly to Dover Harbour; thence north westerly to Northeast Branch Lakes; thence south-southwesterly to the point of origin of Kyak Brook; thence along Kyak Brook, to the Atlantic Ocean; thence eastwardly, following the shore of the Atlantic Ocean, to the mouth of Gasperaux Brook; thence northerly along Gasperaux Brook, to a point near Seven Island Lake; thence northwestward, to the point of beginning, as shown on the map set forth in Schedule "A" attached to and forming part of the report and recommendation;
      (e) appoint the following persons as commissioners for the Little Dover Fire Protection District to hold office until replaced at the first meeting of the ratepayers to be held within six months of the date of incorporation: Mike Casey, of Little Dover, Guysborough County; Mike Bouchie of Little Dover, Guysborough County; and Rick Casey of Little Dover, Guysborough County.

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs dated February 20, 1997, pursuant to subsection 31(2) of Chapter 296 of the Revised Statutes of Nova Scotia, 1989, the Municipal Affairs Act and The Appropriations Act, is pleased to:
      (a) authorize the Minister of Housing and Municipal Affairs and the Minister of Finance to enter into an Amending Agreement amending the Canada-Nova Scotia Infrastructure Works Program Agreement with the Government of Canada, for a term of approximately one year beginning on April 1, 1997, to include substantially the programs, terms and conditions outlined in the Amending Agreement attached in draft form as Schedule "A" in the form attached to and forming part of the report and recommendation; and
      (b) authorize the Minister of Housing and Municipal Affairs and the Minister of Finance to execute the Amending Agreement referred to in paragraph (a) and such other documents and agreements in such form as the Department of Justice may approve as may be deemed necessary to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister responsible for the administration of Part II of the Gaming Control Act, dated February 7, 1997, pursuant to Section 127 of Chapter 4 of the Statutes of Nova Scotia, 1994-95, the Gaming Control Act, is pleased to amend the Bingo Regulations made by Order in Council 95-256, dated April 4, 1995, as amended, in the manner set out in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister responsible for the Liquor Control Act, dated February 5, 1997, is pleased to approve of the following amendments made by the Liquor License Board to Schedule "B" of the Liquor License Board Regulations made by the Liquor License Board and approved by the Governor in Council by Order in Council 83-755, dated July 12, 1983, as amended:

Sections (B) and (C) of Schedule "B" of the Liquor License Board Regulations made by the Liquor License Board and approved by the Governor in Council by Order in Council 83-755, dated July 12, 1983, are amended by striking out "11 o'clock" wherever it occurs and substituting "10 o'clock".

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated February 3, 1997, pursuant to Section 26 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to approve of the Minister entering into an agreement with the Town of Oxford relating to work on certain highways within the Town, which work is specified in Maintenance Agreement No. 29-R dated October 1, 1996, set forth in Schedule "A", the location of which is set forth on a Plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Labour dated February 4, 1997, pursuant to clauses 82(1)(ao ) and (ap) of Chapter 7 of the Statutes of Nova Scotia, 1996, the Occupational Health and Safety Act, is pleased:
      (a) effective on, from and after February 25, 1997, to make regulations respecting occupational health and safety appeal panels in the form set forth in Schedule "A" attached to and forming part of the report and recommendation; and
      (b) effective on, from and after December 31, 1997, to repeal regulations respecting adjudication committees made by Order in Council 86-406, dated April 15, 1986.

The Governor in Council on the report and recommendation of the Minister of Labour dated February 5, 1997, pursuant to Section 10 of Chapter 7 of the Statutes of Nova Scotia, 1996, the Occupational Health and Safety Act, is pleased to determine that, for the purpose of paying part of the operating costs of the Occupational Health and Safety Division of the Department of Labour for the fiscal year 1996-97, the sum of $1,450,000.00 shall, prior to March 31, 1997, be paid into the Consolidated Revenue Fund of the Province of Nova Scotia from the Accident Fund by the Workers' Compensation Board.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated February 20, 1997, to the Minister of Finance pursuant to Sections 2, 9, 13, 16 and 17 of Chapter 49 of the Revised Statutes of Nova Scotia, 1989, as amended by the Business Development Corporation Act, and on the report and recommendation of the Minister of Finance pursuant to Section 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) amend Order in Council 96-918, dated December 17, 1996, which authorized assistance to Seagull Pewter and Silversmiths Limited of Pugwash, Cumberland County, by deleting Schedule "A" approved thereby and substituting Schedule "A" attached to the report and recommendation; and
      (b) authorize the Nova Scotia Business Development Corporation to execute such agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency, dated February 5, 1997, to the Minister of Finance pursuant to Sections 2, 9, 13, 16 and 17 of Chapter 49 of the Revised Statutes of Nova Scotia, 1989, the Business Development Corporation Act, and on the report and recommendation of the Minister of Finance pursuant to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) authorize financial assistance to Mosher Limestone Company Limited, Upper Musquodoboit, Halifax Regional Municipality, by way of a guarantee to a chartered bank in such form as the Attorney General may approve in an amount not to exceed Two Hundred Thousand Dollars ($200,000.00) in support of an operating loan for Five Hundred Thousand Dollars ($500,000.00) on terms and conditions as determined by the Nova Scotia Business Development Corporation as set out in Schedule "A" attached to and forming part of the report and recommendation with such minor amendments thereto as the Business Development Corporation Board and the Minister of Economic Renewal Agency deem necessary; and
      (b) authorize the Nova Scotia Business Development Corporation to execute the guarantee and such other agreements and instruments as may be required to give effect to this Order
