Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 13,115 square feet [1218 square metres].

It should be understood that these insertions are not part of the original text.
Any errors in these conversions are my responsibility.

Approved: the 7th day of January, 1997
The Governor in Council on the report and recommendation of the Minister of Finance dated December 11, 1996, pursuant to Sections 2 and 17 of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to direct the Minister of Finance to:
      (1) establish a fund to be called the Gaming Addiction Treatment Trust Fund;
      (2) deposit to the credit of the Gaming Addiction Treatment Trust Fund revenue of the Nova Scotia Gaming Corporation referred to in subsection 29(1) of the Gaming Control Act and Section 32 of the Casino Regulations made thereunder; and
      (3) pay out of the Gaming Addiction Treatment Trust Fund such sum or sums as the Minister, with the advice of the Deputy Minister of Health, may deem appropriate to fund the costs of gaming addiction treatment programs.

The Governor in Council on the report and recommendation of the Minister of Finance dated December 10, 1996, pursuant to subsection 35(3) of Chapter 379 of the Revised Statutes of Nova Scotia, 1989, the Public Trustee Act, is pleased to authorize the Minister of Finance to pay to the persons entitled thereto under an Order of the Supreme Court of Nova Scotia, dated October 10, 1986 [(1986) S.H. No. 58301], and more particularly set out in Schedule "A" to such Order, amounts held by the Minister of Finance pursuant to subsection 28(2) of the Public Trustee act, together with interest, all respecting the sale of shares of Dartmouth Memorial Gardens Limited.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated November 5, 1996, pursuant to Section 26 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to approve of the Minister entering into an agreement with the Town of Amherst relating to work on certain highways within the Town, which work is specified in Construction Agreement No. 1-B, dated September 6, 1996, set forth in Schedule "A", the location of which is set forth on a Plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 5, 1996, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to amend Order in Council 92-694, dated July 14, 1992, respecting the issuance of a lease of Crown land situate at Officers Camp Lake, Halifax Regional Municipality, to Peter M. Jangaard and Margaret B. Jangaard both of Halifax, Halifax Regional Municipality, and Joan E. The Governor in Council on the report and recommendation of the Minister of Finance dated January 8, 1997, pursuant to Section 43A of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased to:
      (a) accept the resignation and revoke the appointment of R. Glenn Hynes, C.A., of Bedford, Halifax Regional Municipality, as Controller, effective December 20, 1996, which appointment was made by Order in Council 96-566, dated July 31, 1996;
      (b) appoint C. Sean O'Connor, C.A., of Bedford, Halifax Regional Municipality, as Controller in the Department of Finance effective January 20, 1997;
      (c) order that C. Sean O'Connor, C.A., shall receive remuneration in accordance with the management compensation plan MCP 35; and

      (a) accept the resignation and revoke the appointment of C. Sean O'Connor, C.A., of Bedford, Halifax Regional Municipality, as Provincial Tax Commissioner in the Department of Business and Consumer Services effective January 20, 1997, which appointment was made by Order in Council 96-806, dated November 5, 1996;
      (b) appoint Thelma Costello, B.A., LL.B., of Indian Harbour, Halifax Regional Municipality, as Provincial Tax Commissioner in the Department of Business and Consumer Services, effective February l, 1997;
      (c) designate Thelma Costello, B.A., LL.B., as Provincial Tax Commissioner in the Department of Business and Consumer Services to be an employee for the purposes of the Public Service Superannuation Act; and

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated December 16, 1996, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 13,115 square feet (0.301 acre) [1218 square metres], more or less, situate at or near Ellershouse, Hants County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B" which Schedules are attached to and form part of the report and recommendation;
      (b) convey the said lands to Ernest L. Pemberton and Jean Pemberton of R.R.#l Ellershouse, Hants County, for the price of $300.50; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 3, 1996, pursuant to Section 8 of Chapter 367 of the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act, is pleased to:
      (a) designate all that area of land situate at Lake George, Kings County, owned by Her Majesty the Queen in right of the Province of Nova Scotia, to be a Provincial Park, the said area of land being described in Schedule "A" and shown outlined in bold line on a copy of Provincial Crown Lands Record Centre Plan No. E-15-53 marked Schedule "B", both Schedules attached to and forming part of the report and recommendation; and
      (b) declare that the Park shall be known by the name of "Lake George Provincial Park".

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated January 9, 1997, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 0.38 acre [1540 square metres], more or less, situate at or near Moser River, Halifax Regional Municipality, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", which Schedules are attached to and forming part of the Report and Recommendation;
      (b) convey the said lands to Joseph R. Poulin and Pauline Poulin of Dartmouth, Halifax Regional Municipality, for the price of $1,290.00; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated January 9, 1997, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a lease by the Minister of Natural Resources of a parcel of submerged Crown land containing 2.1 acres [0.85 hectare], more or less, situate at Gold River, in Mahone Bay, Lunenburg County, as shown outlined in red on the plan marked Schedule "A" attached to and forming part of the Report and Recommendation, to Goldwater Marine Incorporated, a body corporate with head office at Wolfville, Kings County, for the purpose of operating and maintaining a marina and for no other purpose, for a term of five (5) years at an annual rent of Eight Hundred and Sixty-Six Dollars and Twenty-Five Cents ($866.25), with the right to renew the lease for a further five (5) year term at a rent to be fixed by the Lessor, provided that the Lessee has satisfactorily complied with the terms and conditions of the lease.

The Governor in Council on the Report and Recommendation of the Minister of Finance dated January 15, 1997, pursuant to clause 72(1)(a) and subsections 72(3) and 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, and on the Report to the Minister of Finance from the Minister responsible for the Nova Scotia Economic Renewal Agency pursuant to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, and to Order in Council 76-373, dated March 30, 1976, which conferred the status of a Crown Corporation on the Waterfront Development Corporation, is pleased to:
      (a) approve of the Waterfront Development Corporation Limited of Halifax arranging the credit facilities for borrowing from the Bank of Montreal upon the terms and conditions set out in Schedule "A" attached to and forming part of the Report and Recommendation;
      (b) authorize the Minister responsible for the Nova Scotia Economic Renewal Agency to give an ultimate guarantee for borrowings under credit facilities of the Waterfront Development Corporation Limited to the Bank of Montreal up to an amount of Nine Million Dollars ($9,000,000.00) to replace the existing Guarantee authorized by Order in Council 94-85 dated February 2, 1994, for a term commencing on December 30, 1996 and terminating on February 15, 2002, substantially on the terms and conditions contained in Schedule "A" attached to and forming part of the Report and Recommendation; and
      (c) authorize the Minister responsible for the Nova Scotia Economic Renewal Agency to execute such guarantee, agreements and documents as may be required to give effect to this Order, all to be in such form as the Department of Justice may approve.

The Governor in Council on the report and recommendation of the President of the Executive Council dated January 23, 1997, is pleased to amend Order in Council 97-25 dated January 14, 1997, respecting the appointment of the Honourable Sandy Jolly as Acting Minister of Housing and Municipal Affairs by:
      (a) striking out "from 11:05 a.m., Friday, February 7, 1997 to Wednesday, February 12, 1997" in lines two and three of paragraph six and substituting "from 11:05 a.m. to midnight, Friday, February 7, 1997"; and
      (b) adding immediately after paragraph six the following paragraph:

"To be Acting Minister of Housing and Municipal Affairs and to be responsible for any and all other duties assigned to that Minister from Saturday, February 8, 1997 to Wednesday, February 12, 1997: The Honourable Richard Mann;".
