Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 44 feet 11 inches [13.69 metres].

It should be understood that these insertions are not part of the original text.
Any errors in these conversions are my responsibility.

The Governor in Council on the report and recommendation of the Minister of Business and Consumer Services dated October 28, 1996, pursuant to Section 30C of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased, effective November 5, 1996, to:
      (a) accept the resignation and revoke the appointment of R. Glenn Hynes, C.A., of Bedford, Halifax Regional Municipality, as Provincial Tax Commissioner which appointment was made by Order in Council 94-514 dated June 21, 1994;
      (b) appoint C. Sean O'Connor, C.A., of Bedford, Halifax Regional Municipality, as Provincial Tax Commissioner in the Department of Business and Consumer Services;
      (c) designate C. Sean O'Connor, C.A., as Provincial Tax Commissioner in the Department of Business and Consumer Services to be an employee for the purposes of the Public Service Superannuation Act; and
      (d) order that C. Sean O'Connor, C.A., shall receive remuneration in accordance with the management compensation plan MCP 35.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated October 15, 1996, pursuant to subsection 26(1) of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to approve of the Minister entering into an agreement with the Region of Queens Municipality relating to work on certain highways within the Regional Municipality, which work is specified in Construction Agreement No. 22-V, dated August 7, 1996, set forth in Schedule "A", the location of which is set forth on a Plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Natural Resources, dated October 25, 1996, pursuant to clause 16(1)(c) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve Petition No. 35356 and to transfer to Her Majesty the Queen in right of Canada, the administration and control of a parcel of Provincial Crown land being land and land covered by water containing an area of 3.84 hectares, more or less, situate at Gunning Cove, Shelburne County, for marine and related purposes, the said parcel of Provincial Crown land more particularly described in Schedule "A" and marked as Parcel "96-1" and shown outlined in red on the plan marked Schedule "B", both Schedules attached to and forming part of the report and recommendation, at a cost of Five Thousand Two Hundred Dollars ($5,200.00), being the cost of 1.20 hectares situate more than 75 metres from federal facilities, and to authorize the Minister of Natural Resources to execute such documents as are necessary to achieve the purpose of this Order.

The Governor in Council on the report and recommendation of the Minister of Natural Resources, dated October 25, 1996, pursuant to clause 16(1)(c) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve Petition No. 35653 and to transfer to Her Majesty the Queen in right of Canada, the administration and control of a parcel of Provincial Crown land being land and land covered by water containing an area of 2,528 square feet [235 square metres], more or less, situate at Mahone Bay, Lunenburg County, required for divestiture of federal property, the said parcel of Provincial Crown land being more particularly described in Schedule "A" and marked as parcel B and shown outlined in red on the plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation, and to authorize the Minister of Natural Resources to execute such documents as are necessary to achieve the purpose of this Order.

Silver Seas 1, from Little Benj Fisheries Ltd., of Clark's Harbour, Shelburne County, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated October 9, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to approve of the Nova Scotia Fisheries Loan Board making a net loan of a sum not exceeding One Hundred Twenty-Five Thousand Seven Hundred Four Dollars ($125,704.00) to Davis E. Nickerson of R.R.#1 Woods Harbour, Shelburne County, to finance the purchase of a new 42 foot [12.8 metre] fibreglass lobster / handline boat from Dixon's Boatbuilders Limited of Woods Harbour, Shelburne County, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated October 9, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to amend Order in Council 96-344 dated May 7, 1996, respecting a Nova Scotia Fisheries Loan Board loan to Twin Island Farms Limited, by:

      l.   deleting the words, figures and symbols "Eighty-Three Thousand Six Hundred Eighty Dollars ($83,680.00)" wherever they appear therein, and substituting therefor the words, figures and symbols "Seventy Thousand Two Hundred Nine Dollars and Fifty Cents ($70,209.50)"; and
      2.   deleting Schedule "A" approved by Order in Council 96-344 and substituting therefor the Revised Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated October 9, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to approve of the Nova Scotia Fisheries Loan Board making a net loan of a sum not exceeding One Hundred Eleven Thousand Eight Hundred Twenty-Five Dollars and Sixty Cents ($111,825.60) to Maiden Fisheries Limited of Belle Cote, Inverness County, to finance the purchase of a new 43 foot [13.1 metre] open fibreglass lobster / crab boat from Donelle Boatbuilder Limited of Cap Pele, in the Province of New Brunswick, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated October 9, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to approve of the Nova Scotia Fisheries Loan Board making a net loan of a sum not exceeding One Hundred Fourteen Thousand Forty-Nine Dollars and Sixty Cents ($114,049.60) to Paul D. Adams of Shag Harbour, Shelburne County, to finance the purchase of a new 42 foot [12.8 metre] open fibreglass lobster / handline boat from Dixon's Boatbuilders Limited of Woods Harbour, Shelburne County, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated October 9, 1996, pursuant to clause 8(b) and clause 18(1)(f) of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to:
      (a) approve of the Nova Scotia Fisheries Loan Board entering into an agreement with Mark G. Weagle of Port Maitland, Yarmouth County, by which agreement the fisherman is to assume the payment of the mortgage on the boat owned by Martine Marie Fisheries Limited of Middle West Pubnico, Yarmouth County, the financing and mortgaging of which vessel was authorized by Order in Council 96-149 dated March 5, 1996;
      (b) order that the agreement referred to in this Order is subject to the conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the recommendation of the Minister of Justice and Attorney General dated October 18, 1996 pursuant to the Justices of the Peace Act, is pleased to revoke the appointment of Sandra Stuart of Shelburne, Shelburne County as a Justice of the Peace, effective September 30, 1996.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated October 29, 1996, pursuant to Sections 2, 3 and 4 of Chapter 222 of the Revised Statutes of Nova Scotia, 1989, the Industrial Development Act, is pleased to:
      (a) authorize the Province to enter into an agreement with Newbridge Networks Corporation substantially on terms and conditions as outlined on Schedule "A" attached to and forming part of the report and recommendation;
      (b) authorize the Minister responsible for the Nova Scotia Economic Renewal Agency to execute said Agreement; and
      (c) charge against the free balance of the Industrial Expansion Fund the sum of Eight Million Dollars ($8,000,000.00),

      (a) authorize financial assistance to Lawrence and Dianne Outhouse and Rodney and Susan O'Neil of Tiverton, Digby County, carrying on business as Double "O" Fish Farm Limited by way of a guarantee to a chartered bank in such form as the Attorney General may approve in an amount not to exceed $100,000.00 in support of an operating line of credit for $125,000.00, on terms and conditions determined by the Nova Scotia Fisheries Loan Board and set out in Schedule "A" attached to and forming part of the Report and Recommendation; and

      (a) authorize financial assistance to Roger Hammond and Kevin Siddall of Hubley, Halifax Regional Municipality, carrying on business as Big Falls Fish Growers Limited by way of a guarantee to a chartered bank in such form as the Attorney General may approve in an amount not to exceed $100,000.00 in support of an operating line of credit for $100,000.00, on terms and conditions determined by the Nova Scotia Fisheries Loan Board and set out in Schedule "A" attached to and forming part of the Report and Recommendation; and
      (b) authorize the Nova Scotia Fisheries Loan Board to execute such guarantee and such other agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister of Finance, with the advice of the Minister of Fisheries, dated October 11, 1996, pursuant to Sections 7 and 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, and to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) authorize financial assistance to Brian Giroux and Richard Stewart of Yarmouth, Yarmouth County, carrying on business as Supreme Marine Seed by way of a guarantee to a chartered bank in such form as the Attorney General may approve in an amount not to exceed $40,000.00 in support of an operating line of credit for $40,000.00, on terms and conditions determined by the Nova Scotia Fisheries Loan Board and set out in Schedule "A" attached to and forming part of the Report and Recommendation; and
      (b) authorize the Nova Scotia Fisheries Loan Board to execute such guarantee and such other agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs dated October 24, 1996, and pursuant to Section 15 of Chapter 302 of the Revised Statutes of Nova Scotia, 1989, the Municipal Grants Act, is pleased to approve the agreement between the Town of Amherst and SCL Technologies Inc. under which the Town grants a tax exemption to SCL Technologies Inc., which agreement is attached as Schedule "A" to and forming part of the Report and Recommendation.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated October 22, 1996, pursuant to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to:
      (a) convey certain lands containing 4.3 acres [1.7 hectares], more or less, situate at or near New Victoria, Cape Breton Regional Municipality, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", which Schedules are attached to and form part of the Report and Recommendation;
      (b) convey the said lands to David and Cindy Hynes of New Waterford, Cape Breton Regional Municipality, in exchange for other lands; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of the Environment dated September 11, 1996, pursuant to Section 102 of Chapter 1 of the Statutes of Nova Scotia, 1994-95, the Environment Act, is pleased to amend the Solid Waste-Resource Management Regulations, made by Order in Council 96-79 dated February 6, 1996, in the manner set forth in Schedule "A" attached to and forming part of the Report and Recommendation, effective on, from and after November 12, 1996.

      (a) determine that the sum equal to 3.5% of the assessed revenue generated from the actual assessed payroll of the concrete ready mix industry designated as SIC 3551 by the Workers' Compensation Board of Nova Scotia, shall be paid out of the Accident Fund by the Workers' Compensation Board to the Nova Scotia Construction Safety Association for the purposes of paying part of the costs of the construction safety training program that is conducted by the Nova Scotia Construction Safety Association and approved by the Nova Scotia Department of Labour, and provide that this determination shall be effective in respect of assessed revenue in relation to the actual assessed payroll for the calendar year of 1996;
      (b) determine that the sum equal to 3.25 of the assessed revenue generated from the actual assessed payroll of the construction industries designated as SIC 4011 - 4499, and the concrete ready mix industry designated as SIC 3551, by the Workers' Compensation Board of Nova Scotia, shall be paid out of the Accident Fund by the Workers' Compensation Board to the Nova Scotia Construction Safety Association for the purposes of paying part of the costs of the construction safety training program that is conducted by the Nova Scotia Construction Safety Association and approved by the Nova Scotia Department of Labour; and
      (c) provide that the determination in the preceding paragraph (b) shall be effective in respect of assessed revenue in relation to the actual assessed payroll of the calendar year of 1997, and each subsequent year until a different determination is made, and for greater certainty, may be paid out by installments during the year.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated August 20, 1996, pursuant to Section 10 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to approve the expropriation by Her Majesty the Queen in the Right of the Province of Nova Scotia, of land situate, lying and being at or near the Districts of Masstown and Sutherland Lake, Colchester County, and being more particularly described in Schedule "A" and shown outlined in red on a plan marked Schedules B1, B2, B3, B4, B5, B6, B7, B8, B9, B10, B11, B12, B13, B14, B15, B16, B17, B18, B19, B20A, B20, B21, B22, B23, B24, B25, and B26 which schedules are attached to and form part of the report and recommendation of the Minister of Transportation and Public Works, and saving and excepting and reserving those properties identified at page 22 of Schedule "A", the said expropriation being for a public purpose; namely, for the purpose of a public highway.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated October 31, 1996, pursuant to Section 6 of Chapter 168 of the Revised Statutes of Nova Scotia, 1989, the Ferries Act, is pleased to revoke Orders in Council 80-26, dated January 8, 1980, Order in Council 78-1363, dated November 21, 1978 and an Order in Council dated October 13, 1965, and is further pleased to order that ferriage charges on the respective ferries be those set out as Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Agriculture and Marketing dated October 16, 1996, pursuant to subsection 87(1) of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased to authorize the Minister of Agriculture and Marketing to enter into an agreement with the Government of Canada for the implementation of the Canada / Nova Scotia Agreement under the Canadian Farm Business Management Program substantially in the form set forth in Schedule "A" attached to and forming part of the report and recommendation.

Belliveau Contracting & Boatbuilding Limited of Lower West Pubnico, Yarmouth County, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Labour dated October 3, 1996, pursuant to Section 46 of Chapter 320 of the Revised Statutes of Nova Scotia, 1989, the Occupational Health and Safety Act, is pleased to:
      (a) determine that the sum equal to 2.5 percent of the assessed revenue generated from the actual assessed payroll of the retail gasoline industry designated as SIC code 6331 by the Workers' Compensation Board of Nova Scotia shall be paid out of the Accident Fund by the Workers' Compensation Board to the Retail Gasoline Dealers Association for the purpose of paying part of the operating costs of a Retail Gasoline Safety and Health Training Program conducted by the Retail Gasoline Dealers Association; and
      (b) provide that this determination shall be effective in respect of assessed revenue in relation to the actual assessed payroll for the calendar year of 1997, and each subsequent year, and, for greater certainty, may be paid out by instalments during the year.
