Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 23' × 58' [7.0 metre × 17.7 metre] room.

It should be understood that these insertions are not part of the original text.

The Governor in Council on the report and recommendation of the Minister of Finance dated August 1, 1996, with the advice of the Minister responsible for the Sydney Steel Corporation, and pursuant to clause 26(1)(b) of Chapter 456 of the Revised Statutes of Nova Scotia, 1989, the Sydney Steel Corporation Act, and subsection 72(3) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, and a Resolution of the Corporation passed May 31, 1993, a copy of which Resolution is attached to the said report and recommendation, is pleased to amend Order in Council 95-10, dated January 3, 1995, as amended by Order in Council 96-555, dated July 17, 1996, for the purpose of honouring, in part, a Joint Operation, Sale and Long Term Agreement entered into by Sydney Steel Corporation, 2407601 Nova Scotia Limited, China National Minmetals & Minerals Import & Export Corporation and Her Majesty the Queen in right of the Province of Nova Scotia and for the purpose of funding the cash flow requirements of Sydney Steel Corporation to December 31, 1996, by deleting from the fourth line of paragraph (b) thereof the words, symbols, numbers and punctuation "Fourteen Million Six Hundred Thousand Dollars ($14,600,000)" and substituting therefor the words, symbols, numbers and punctuation "Twenty-one Million Six Hundred Thousand Dollars ($21,600,000)".

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs and the Minister responsible for the Housing Development Corporation Act and the Minister of Finance dated July 16, 1996, pursuant to Section 60, clause 70(d) and subsection 72(1) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, as amended, and subsections 6(1) and (2), clause 9(1)(c) and Section 10 of Chapter 213 of the Revised Statutes of Nova Scotia, 1989, the Nova Scotia Housing Development Corporation Act, and of every other power and authority in him vested in this behalf is pleased to:
      (a) authorize the Nova Scotia Housing Development Corporation (the "Corporation") to borrow up to $1,133,500.60 at an interest rate and upon the terms and conditions which are set out in an Agreement attached to a Resolution of the Corporation, (the "Loan"), for the purchase of Vimy Apartments, 2030-38 Gottingen Street, Halifax, (the "Project"), from Canada Mortgage and Housing Corporation, all upon such terms and conditions as the Corporation approved by resolution passed by the Corporation on May 28, 1996, as it may be amended from time to time, a certified copy of which resolution is marked Schedule "A" attached to and forming part of the report and recommendation, (the "Resolution");
      (b) approve;

(i) the Resolution and Schedules attached thereto which contain the terms and conditions of the Loan;
(ii) the transfer of the property described in paragraph (a) to the Corporation and which is owned by Her Majesty in Right of the Province as represented by the Minister of Housing and Municipal Affairs or otherwise, and
(iii) the mortgaging of the property described in paragraph (a) upon the terms and conditions contained in the Resolution of the Corporation and Schedules attached thereto, subject to Section 10 of the said Nova Scotia Housing Development Corporation Act;
(iv) the granting or assignment to the Corporation of National Housing Act insured real property mortgages and held by the Minister of Housing and Municipal Affairs or otherwise and the granting or assignment of such mortgages by the Corporation to Canada Mortgage and Housing Corporation as security for the Loan upon the terms and conditions contained in the Resolution and Schedules attached thereto;
(v) the authorization of the Minister of Housing and Municipal Affairs or for him the Deputy Minister of Housing and Municipal Affairs, on behalf of the Corporation, to execute committment letters, agreements, deeds, assignments, mortgages, chattel mortgages, promissory notes or other documents or amendments thereto as may be required for the Loan in such form and with such changes thereto as the person signing may in her or his sole discretion deem necessary, the fact of her or his executing such document to be conclusive evidence of her or his approval of any changes contained therein, all as authorized by the Resolution; and,

      (c) authorize that all necessary and proper proceedings be taken by the Minister of Housing and Municipal Affairs or Minister of Finance to obtain the Loan by the Corporation.

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs dated July 16, 1996, and pursuant to Sections 3 and subsection 6(1) of Chapter 211 of the Revised Statutes of Nova Scotia, 1989, the Housing Act, is pleased to authorize the Minister of Housing and Municipal Affairs to enter into and execute:
      (a) a Memorandum of Agreement with Canada Mortgage and Housing Corporation for the purpose of establishing a Home Adaptation for Seniors' Independence (HASI) Housing Program, in a from substantially as set out in Schedule "A" attached to and forming part of the Report and Recommendation, the costs of such program to be cost shared 25/75% between the Province and CMHC; and
      (b) agreements upon such terms and with such persons as he deems necessary in order to carry out the terms of the HASI Program.

The Governor in Council on the report and recommendation of the Minister of Housing and Municipal Affairs dated July 18, 1996, and pursuant to clause 19(f) of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to revoke Order in Council 84-1463 dated December 18, 1984, respecting Housing Authority by-laws, effective August 14, 1996.

The Governor in Council on the report and recommendation of the Minister of Business and Consumer Services dated July 8, 1996, is pleased to revoke the appointment of Norman MacLean of New Waterford, Cape Breton Regional Municipality, as a Deputy Issuer of Marriage Licenses at District No. 9, Town of New Waterford and Polling District No. 20 (Lingan).

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 23, 1996, and pursuant to Section 26 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to approve of the Minister entering into an agreement with the Town of Parrsboro to work on certain highways within the Town, which work is specified in Construction Agreement No. 16-X, dated June 17, 1996, set forth in Schedule "A", the location of which is set forth on a Plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation.

Approved: the 14th day of August, 1996
The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 17, 1996, and pursuant to Section 11 of Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, and to all other powers vested in him by virtue of his office, is pleased to:
      (a) ratify and confirm the agreements entered into with Scott Maritimes Limited, now Kimberly-Clark Canada Limited, for the transfer of all operating responsibility for the Boat Harbour effluent treatment facility from the Province to Kimberly-Clark for a maximum period of 10 years, and the renewal for a further period of 25 years of the agreement between the Province and Kimberly-Clark for the supply of water to the Kimberly-Clark Abercrombie Point Pulp Mill, on the terms and conditions attached to and forming part of the report and recommendation as Schedule "A" to this agreement; and
      (b) authorize the Minister of Transportation and Public Works to transfer such portion of the Boat Harbour effluent treatment facility lands as the Minister deems appropriate at no charge to the Pictou Landing Mi'kmaq Band, or to the federal Department of Indian Affairs and Northern Development for the benefit of the Band, when the lands are no longer required for the operation of the effluent treatment facility, or at such sooner time as the Minister deems appropriate so long as any earlier transfer is on such terms and conditions as do not interfere with the continued operation of the effluent treatment facility for the duration of the operating agreement with Kimberly-Clark Canada Limited, and such additional time as is required to perform clean up operations.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 19, 1996, and pursuant to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to:
      (a) dispose of certain lands containing 3.0 acres [1.2 hectares], more or less, situate at or near Baddeck, Victoria County, and more particularly described in Schedule "A" and shown on Schedule "B" attached to and forming part of the report and recommendation;
      (b) convey the said lands to The Mingo Group Inc. of New Glasgow, Pictou County, for the price of $9,000.00; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 9, 1996, and pursuant to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to:
      (a) convey to the Estate of Willard Ripley the interest and title of Her Majesty the Queen in land situate in Halifax Regional Municipality, described in Schedule "A" and shown outlined in red in Schedule "B" which is attached to and forming part of the report and recommendation; and
      (b) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 9, 1996, pursuant to every power and authority vested in him is pleased to authorize the Minister of Transportation and Public Works, on behalf of Her Majesty the Queen in the Right of Her Province of Nova Scotia, to accept from Her Majesty the Queen in the Right of Canada, at no cost, the transfer of administration and control of a parcel of land, containing 2,855 square feet [265 square metres], more or less, said lands are situate at Sheet Harbour Passage, Halifax Regional Municipality, and being more particularly described in Schedule "A" attached to and forming part of Federal Real Property Document, File No. H-3080-422 dated August 24, 1995.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 5, 1996, pursuant to every power and authority vested in him is pleased to authorize the Minister of Transportation and Public Works, on behalf of Her Majesty the Queen in the Right of Her Province of Nova Scotia, to accept from Her Majesty the Queen in the Right of Canada, at no cost, the transfer of administration and control of a parcel of land, containing 2.27 acres [0.919 hectares], more or less, said lands are situate at East Port L'Hebert, Region of Queens Municipality, and being more particularly described in Schedule "A" attached to and forming part of Federal Real Property Document, File No. H-3080-318 dated March 27, 1996.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 23, 1996, and pursuant to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to:
      (a) release the portion of the easement acquired on behalf of Her Majesty the Queen in the Right of the Province by Indenture dated November 24, 1980, from Walter O. Newton and Terry W. Whynot to Kent Field Estates Ltd., said easement being situate at or near Old English Subdivision, North Kentville, Kings County, and more particularly described in Schedule "A" as Parcel "B" and shown outlined in red on Schedule "B" attached to and forming part of the report and recommendation; and
      (b) authorize the Minister of Transportation and Public Works to prepare and execute the necessary documents to carry out the said release.

The Governor in Council on the report and recommendation of the Minister responsible for the Advisory Council on the Status of Women Act, dated July 31, 1996, pursuant to subsection 10(1) of Chapter 70 of the Revised Statutes of Nova Scotia, 1989, the Civil Service Act, is pleased to designate Mildred Royer as deputy head within the meaning of the Civil Service Act for the Advisory Council on the Status of Women effective August 1, 1996, until revoked by the Governor in Council.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated July 19, 1996, pursuant to subsections 22(2) and (3) of Chapter 18 of the Statutes of Nova Scotia, 1990, the Mineral Resources Act, is pleased to approve the Minister of Natural Resources granting special licenses to Allister Peach of Truro, Colchester County, substantially in the form and on the terms and conditions stated in the Special Licenses attached to and forming part of the Report and Recommendations as Appendix "1" and Appendix "2".

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated July 18, 1996, and pursuant to clauses 7(c) and 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and to Section 13 of Chapter 504 of the Revised Statutes of Nova Scotia, 1989, the Wildlife Act, and pursuant to the terms of the Implementation Agreement signed June 16, 1994, between Ducks Unlimited Canada and Her Majesty the Queen in right of the Province of Nova Scotia, is pleased:
      (a) subject to the terms and conditions outlined in paragraph (b), to authorize the conveyance by deed or grant of a parcel of Crown land containing approximately 203 acres± [82.2 hectares±] situate at River Denys, Inverness County, to Harag Incorporated, its successors and assigns, the Crown lands shown outlined in green on the plan marked Schedule "B" attached to and forming part of the Report and Recommendation;
      (b) in exchange for the Crown lands referred to in paragraph (a), to accept from Harag Incorporated, its successors and assigns, on behalf of Her Majesty the Queen in right of the Province of Nova Scotia, the sum of $6,600.00 along with the conveyance of a parcel of land containing 210 acres± [85.0 hectares±], subject to survey, situate at Big Marsh, Inverness County, the parcel of land shown outlined in red on the plan marked Schedule "A" attached to and forming part of the report and recommendation, provided that title to the lands can be certified in a manner acceptable to the Department of Justice; and
      (c) to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.

The Governor in Council on the report and recommendation of the Minister of Agriculture and Marketing dated July 17, 1996, pursuant to subsection 3(1) and clauses 20(a) and (b) of Chapter 501 of the Revised Statutes of Nova Scotia, 1989, the Weed Control Act, is pleased to amend the Weed Control Regulations made by Order in Council 68-265, dated April 9, 1968, in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister responsible for the Sydney Steel Corporation Act dated July 31, 1996, pursuant to subsection 8(1) of Chapter 456 of the Revised Statutes of Nova Scotia, 1989, the Sydney Steel Corporation Act, is pleased to:
      (a) accept the resignation, and revoke the appointment of Bernard Boudreau as a director of Sydney Steel Corporation, which appointment was made by Order in Council 95-122, dated February 14, 1995; and
      (b) appoint Manning MacDonald, Minister responsible for Sydney Steel Corporation, as a director of Sydney Steel Corporation for a term of office commencing June 28, 1996.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated August 13, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to approve of the Nova Scotia Fisheries Loan Board making a net loan of a sum not exceeding One Hundred Twenty-Five Thousand Dollars ($125,000.00) to Big Falls Fish Growers Limited of Five Island Road, Hubley, Halifax Regional Municipality, to construct a steelhead salmon hatchery on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Labour dated August 6, 1996, pursuant to Sections 238, 239 and 244 of Chapter 10 of the Statutes of Nova Scotia, 1994-95, the Workers' Compensation Act, is pleased to:
      (a) revoke the appointment of Barbara LeGay as a part-time member of the Workers' Compensation Appeals Tribunal;
      (b) appoint Donna Foulkes of Dartmouth, Halifax Regional Municipality, Raymond Jacquard of Yarmouth, Yarmouth County, Sweeney Hinchey, Q.C., of New Waterford, Cape Breton Regional Municipality, and Edward Colborne of Sydney River, Cape Breton Regional Municipality, as part-time members of the Workers' Compensation Appeals Tribunal, with terms ending September 1, 1997;
      (c) appoint Roland Deveau of Yarmouth, Yarmouth County, as a part-time member of the Workers' Compensation Appeals Tribunal, with terms ending September 1, 1999; and
      (d) fix the remuneration of Donna Foulkes, Raymond Jacquard, Sweeney Hinchey, Edward Colborne and Roland Deveau at the rate of $291.00 for each day they attend to the business of the Workers' Compensation Appeals Tribunal at the request of the Chief Appeals Commissioner.

The Governor in Council on the report and recommendation of the Minister of Labour dated July 23, 1996, pursuant to subsections (1), (2), (3), (4), (5) and (6) of Section 151, to subsections (1) and (2) of Section 152 and to subsections (1) and (2) of Section 153 of Chapter 10 of the Statutes of Nova Scotia, 1994-95, the Workers' Compensation Act, is pleased to:
      (a) reappoint Jim Sapp of Liverpool, Region of Queens Municipality, as a member of the Workers' Compensation Board for a term commencing October 1, 1996, and ending September 30, 1997;
      (b) reappoint Wally Power of Port Hawkesbury, Inverness County, as a member of the Workers' Compensation Board for a term commencing October 2, 1996, and ending September 30, 1998;
      (c) reappoint John Bishop of Halifax, Halifax Regional Municipality, as a member and Deputy Chair of the Workers' Compensation Board for a term commencing October 2, 1996, and ending September 30, 1999;
      (d) determine the remuneration of Jim Sapp and Wally Power to be at the rate of $145.50 for each day spent in attendance at a meeting of the Board, plus actual and reasonable expenses incurred by them in the discharge of their duties; and
      (e) determine the remuneration of John Bishop as member and Deputy Chair to be at the rate of $145.50 for each day spent in attendance at a meeting of the Board as a member only, and to be $194.00 for each day spent in attendance at a meeting in the place of the Chair, plus actual and reasonable expenses incurred by him in the course of his duties.

The Governor in Council on the report and recommendation of the Minister of Human Resources dated August 8, 1996, pursuant to subsection 45(1) of Chapter 70 of the Revised Statutes of Nova Scotia, 1989, the Civil Service Act, is pleased to approve of amendments to the regulations under the Civil Service Act respecting special leave, pregnancy leave, adoption leave, pre-paid leave, and education leave, as approved by the Governor in Council by Order in Council 81-268, dated March 3, 1981, in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation, such amendments to be effective on, from, and after September 1, 1996.
