Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 1.179 acres [4771 square metres].

It should be understood that these insertions are not part of the original text.

      (a) revoke the appointment of Severin LeForte of Port Hawkesbury, Inverness County, as a Commissioner for taking affidavits, which appointment was made by Order in Council 78-950, dated August 15, 1978, while employed with the Registry of Motor Vehicles;
      (b) appoint Severin LeFort of Cheticamp, Inverness County, as a Commissioner for taking affidavits, while employed with the Province of Nova Scotia.

The Governor in Council on the report and recommendation of the Minister of Justice and Attorney General dated June 14, 1996, pursuant to the Public Offices and Officers Act, the Interpretation Act and the Probate Act, is pleased to:
      (a) revoke the appointment of Bernard K. Conrad of Timberlea, Halifax Regional Municipality, as Deputy Inspector of Legal and Registry Offices, which appointment was made by Order in Council 85-1016, dated September 17, 1985, and as Deputy Registrar of Probate for each of the probate districts within the Province of Nova Scotia, which appointment was made by Order in Council 95-197, dated March 14, 1995; and
      (b) appoint Shauna Wilson of Sydney, Cape Breton Regional Municipality, as Deputy Registrar of Probate for each of the probate districts within the Province of Nova Scotia, effective July 3, 1996.

The Governor in Council on the report and recommendation of the Minister of Education and Culture dated June 13, 1996, is pleased to amend Order in Council 91-941, dated August 15, 1991, by:
      (a) deleting clause (a) and substituting the following clause:

(a) establish "The Dr. P. Anthony Johnstone Memorial Fund" from which the Dr. P. Anthony Johnstone Memorial Fund Entrance Scholarship is to be paid;

      (b) deleting clause (b) and substituting the following clause:

(b) close "The Dr. P. Anthony Johnstone Memorial Fund" now maintained at the Department of Finance and transfer the balance of monies in the "Fund" to the Department of Education and Culture;

      (c) deleting subsection (iii) of clause (e) and substitute the following clause:

(iii)  determine the requirements for eligibility, advertise for and receive applications and make recommendations to the Minister of Education and Culture for the award of the Scholarship;

      (d) add two additional sections to clause (e):

(iv)  review every three years the appropriateness of the funding and Scholarship eligibility requirements and submit the review in a report to the Minister of Education and Culture,
(v)  submit the first report no later than March 31, 1998;

      (e) deleting clause (g) and substituting the following clause:

(g) direct the Minister of Education and Culture to make a payment in each year of not more than one Scholarship in the amount of Five Thousand Dollars ($5,000.00).

The Governor in Council on the report and recommendation of the Minister of Education and Culture dated June 13, 1996, pursuant to all authority in him vested, is pleased to:
      (a) establish the Women in Engineering Scholarship at the Technical University of Nova Scotia in the amount of $5,000.00 per annum; this Scholarship is to encourage women to enter engineering careers and to recognize excellence in women in engineering;
      (b) authorize the Minister of Education and Culture to annually charge the appropriation of the Department of Education and Culture for the purpose of this award;
      (c) authorize the payment of the Scholarship annually to the female recipient in the third year of Engineering studies at the Technical University of Nova Scotia, with award to be eligible for renewal for one additional year;
      (d) authorize the Minister of Education and Culture to augment the Scholarship and Awards Committee of the Technical University of Nova Scotia by at least one member appointed by the Minister of Education and Culture for the deliberations on applicants for the yearly Women in Engineering Scholarship; and
      (e) authorize the Scholarship and Awards Committee of the Technical University of Nova Scotia to:

(i)  administer all affairs and matters relating to the Scholarship,
(ii)  determine the Scholarship eligibility requirements,
(iii)  award the Scholarship, yearly, to a female candidate who meets the eligibility requirements,
(iv)  annually report to the Minister of Education and Culture the name and status of the Scholarship winner,
(v)  require the Scholarship winner by July 1, annually, to make a detailed written report on her year's study to the Committee for transmittal to the Minister of Education and Culture,
(vi)  review at least every three years the appropriateness of the funding and the Scholarship eligibility requirements especially considering the clear purpose for this Scholarship, and to submit the review in a written report to the Minister of Education and Culture, in a format that may be determined by the Minister of Education and Culture, and
(vii)  submit the first report no later than March 31, 1997.

The Governor in Council on the report and recommendation of the Minister of Education and Culture dated June 13, 1996, pursuant to Section 38 of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased, effective March 29, 1996, to revoke:
      (a) the appointment of Gerrie Masters of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Council on Higher Education in the category of Senior Public Official representative, which appointment was made by Order in Council 94-843 dated October 11, 1994; and
      (b) the appointment of Dr. Cecil Abrahams of Wolfville, Kings County, as a member of the Nova Scotia Council on Higher Education the category of "Academic" representative, which appointment was made by Order in Council 94-483, dated June 7, 1994.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated June 14, 1996, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 18,575.9 square feet [1725.8 square metres] more or less, situate at or near Head of Chezzetcook, Halifax Regional Municipality, and more particularly described in Schedule "A" and shown on Schedule "B", which Schedules are attached to and form part of the report and recommendation;
      (b) convey the said lands to The Rector, Wardens and Vestry of St. James Church, Parish of Seaforth, of Seaforth, Halifax Regional Municipality, for the price of $151.00; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated June 7, 1996, pursuant to Section 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a grant and/or deed by the Minister of Natural Resources to convey a parcel of Crown land containing 10.12 acres [4.095 hectares], more or less, situate at Trenton, Pictou County, and shown outlined in red on the plan marked Schedule "A" attached to and forming part of the report and recommendation, to Nova Scotia Power Incorporated, a body corporate with its head office at Halifax, Halifax Regional Municipality, for the consideration of Thirty-One Thousand Dollars ($31,000.00) and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated June 13, 1996, pursuant to Section 8 of Chapter 367 of the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act, and to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to:
      (a) rescind Order in Council 76-1405, dated November 30, 1976, and terminate the status of Two Rivers Provincial Park as a provincial park; and
      (b) approve the issuance of a lease by the Minister of Natural Resources of a parcel of Crown land containing 425 acres [172 hectares], more or less, situate at or near Rock Elm, Cape Breton Regional Municipality, as described in Schedule "A" and shown in bold on Schedule "B", on the terms and conditions as set out in Schedule "C", all schedules attached to and forming part of the report and recommendation, to the Two Rivers Development Association, a society with its head office at Marion Bridge, Cape Breton Regional Municipality, for the purposes of maintaining and operating a wildlife park, recreational trails and leisure park open to the general public for a term of ten (10) years at the annual rent of one dollar ($1.00) with the right to renew the lease for a further ten (10) year term at the rent as provided in Schedule "C", provided that the Lessee has satisfactorily complied with the terms and conditions of the lease.

The Governor in Council on the report and recommendation of the Minister of Fisheries dated June 7, 1996, pursuant to Section 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to approve the Nova Scotia Fisheries Loan Board making a net loan of a sum not exceeding One Hundred Thirty-Eight Thousand Eight Hundred Thirteen Dollars and Eighty Cents ($138,813.80) to Seeker Fisheries Limited of Baccaro, Shelburne County, to finance the purchase of a new 44 foot, 11 inch [13.69 metres] decked fibreglass lobster/longliner/swordfish boat from Aylward Fibreglass Ltd. of Clarks Harbour, Shelburne County, on the terms and conditions set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated March 1, 1996, pursuant to Sections 2, 3 and 4 of Chapter 222 of the Revised Statutes of Nova Scotia, 1989, the Industrial Development Act, is pleased to:
      (a) authorize financial assistance to Pratt & Whitney Canada Inc. in an amount not to exceed Three Million Dollars ($3,000,000.00) on the terms and conditions outlined in Schedule "A" attached to and forming part of the report and recommendation;
      (b) charge to the Free Balance of the Industrial Expansion Fund the sum of Three Million Dollars ($3,000,000.00) for the proposed financial assistance; and
      (c) authorize the Nova Scotia Business Development Corporation to execute such agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the President of the Executive Council dated June 27, 1996, pursuant to Section 7 of Chapter 155 of the Revised Statutes of Nova Scotia, 1989, the Executive Council Act, is pleased to determine that the annual salary of the Honourable Wayne Gaudet shall be paid at the same rate as is paid to a Member of the Executive Council having charge of a Department during the period commencing June 1, 1996, and ending the last day of the month in which the member ceases to hold the office in respect of which the salary is being paid.

The Governor in Council on the report and recommendation of the President of the Executive Council dated July 3, 1996, pursuant to the Public Service Act, the Interpretation Act, the Public Service Superannuation Act, the Civil Service Act, and all other authority in him vested, is pleased to:
      (a) revoke the appointment of C.H. Loveless as Deputy Minister of Transportation and Public Works; and
      (b) appoint the undernoted persons to the positions set out opposite their names, effective July 4, 1996:

C.H. Loveless - Deputy Minister of the Nova Scotia Economic Renewal Agency; and
Bruce Atwell - Deputy Minister of Transportation and Public Works;

      (c) designate those persons appointed by paragraph (b) of this Order in Council as deputy heads within the meaning of the Civil Service Act and direct that they shall receive all customary benefits associated with the position of Deputy Minister;
      (d) designate those persons appointed by paragraph (b) of this Order in Council to be and to have been employees for the purposes of the Public Service Superannuation Act; and
      (e) fix and determine the salaries of those persons appointed by paragraph (b) of this Order in Council to be paid at such rate as may be determined by the Priorities and Planning Committee in accordance with the Management Compensation Pay Plan approved from time to time by the Governor in Council.

The Governor in Council on the report and recommendation of the Minister of Finance, with the advice of the Minister of Fisheries, dated June 14, 1996, pursuant to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) authorize financial assistance to Neil LeBlanc, Leo LeBlanc, Kevin LeBlanc and Julian Babin of Lower Wedgeport, Yarmouth County, carrying on business as Tusket Wedge Oyster Farms Ltd. by way of a guarantee to a chartered bank in such form as the Attorney General may approve in an amount not to exceed $45,000.00 in support of an operating line of credit for $50,000.00, on terms and conditions determined by the Nova Scotia Fisheries Loan Board and set out in Schedule "A" attached to and forming part of the Report and Recommendation; and
      (b) authorize the Nova Scotia Fisheries Loan Board to execute such guarantee and such other agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister of Finance dated June 25, 1996, pursuant to Section 92 of Chapter 17 of the Acts of 1995-96, the Revenue Act, is pleased to:
      (a) repeal

(i)  the Health Services Electricity Rates Regulations made by Order in Council 69-289 dated April 3, 1969, and
(ii)  regulations made under the Gasoline and Diesel Oil Tax Act by Order in Council 74-85 dated February 1, 1974; and

      (b) amend the Revenue Act Regulations in the manner set forth in Schedule "A" attached to and forming part of the Report and Recommendation, effective on, from and after July 9, 1996.

The Governor in Council on the report and recommendation of the Minister responsible for Part II of the Gaming Control Act dated June 18, 1996, pursuant to Section 65 of Chapter 4 of the Statutes of Nova Scotia, 1994-95, the Gaming Control Act, is pleased to approve the following delegation of power by the Gaming Control Commission:

to permit or prohibit any amusement in a place of amusement, specifically a machine, contrivance or device, to the persons and under the terms set out in Schedule "A" attached to and forming part of this report and recommendation to be effective on, from and after July 9, 1996.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated June 24, 1996, and pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use those portions of land in Halifax Regional Municipality which are part of the public highway system within the meaning of the Public Highways Act which are listed in Schedule "A", which is attached to and forming part of the report and recommendation;
      (b) convey the public highways referred to in clause (a) and all land, rights of way, easements and road reserves which are contiguous with or adjacent to the said highways and held solely for the purpose of providing support to those said highways, and no other highways, to Halifax Regional Municipality, for the price of $1.00; and
      (c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated June 24, 1996, and pursuant to subsection 26(1) of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to approve of the Minister of Transportation and Public Works entering into an agreement with the Halifax Regional Municipality relating to work on certain highways within the Regional Municipality, which work is specified in the form of agreement which is set forth in Appendix "A" which is attached to and forms part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated June 13, 1996, pursuant to clauses 7(c) and 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased:
      (a) subject to the terms and conditions outlined in paragraph (b), to authorize the conveyance by deed or grant of a lot of Crown land containing 8.9 acres± [3.6 hectares±] situate at Cameron Settlement, Guysborough County, to Donald E. Cameron Limited, the Crown land being more fully shown outlined in green on the plan marked Schedule "A" attached to and forming part of the said report and recommendation;

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated July 4, 1996, pursuant to clause 16(1)(c) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve Petition No. 34684 and to transfer to Her Majesty the Queen in right of Canada, the administration and control of a parcel of Provincial Crown land and land covered by water containing an area of 36.34 acres [14.71 hectares], more or less, situate at West Head, Shelburne County, for marine and related purposes, the said parcel of Provincial Crown land and land covered by water being more particularly described in Schedule "A" and shown outlined in red on the plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation, at a cost of Fourteen Thousand Two Hundred Dollars ($14,200.00), and to authorize the Minister of Natural Resources to execute such documents as are necessary to achieve the purpose of this Order.

The Governor in Council on the report and recommendation of the Minister of Human Resources dated July 17, 1996, pursuant to Section 42 of Chapter 70 of the Revised Statutes of Nova Scotia, 1989, the Civil Service Act, and to every power vested in him thereunder, is pleased to order:
      (a) that Order in Council 79-470, dated April 17, 1979, respecting Long Service Awards, be applied and is hereby amended to include permanent employees in the Correctional Services Division of the Department of Justice;
      (b) that, for the purposes of paragraph (a), entitlement to a Long Service Award is to be based on recognized service with a municipal correctional facility that is otherwise recognized by the Province, as well as on service in the Department of Justice;
      (c) that Long Service Awards shall be granted to permanent employees in the Correctional Services Division of the Department of Justice who completed twenty-five (25) years of service prior to the coming into force of this Order and who were still employed in the Division on the coming into force of this Order; and
      (d) that this Order comes into force on, from and after August 1, 1996.

The Governor in Council on the report and recommendation of the Minister of Justice dated July 26, 1996, and pursuant to subsection 49(1) of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, is pleased to amend the regulations made by the Governor in Council pursuant to the Act by Order in Council 94-537, dated June 28, 1994, by adding after Section 14 the following Section:

15. For the purposes of clause 4(3)(a) of the Act, "administrative proceeding" includes the alternative dispute resolution mechanism provided for in the Memorandum of Understanding Regarding Compensation For Survivors of Institutional Abuse made effective June 17, 1996, between the Province and the Survivors.
