Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 180 acres [72.8 hectares].

It should be understood that these insertions are not part of the original text.

The Governor in Council on the report and recommendation of the Minister of Finance dated January 16, 1996 pursuant to subsection 35(3) of Chapter 379 of the Revised Statutes of Nova Scotia, 1989, the Public Trustee Act, is pleased to authorize the Minister of Finance to pay Michel Tahan of Allentown, in the County of Lehigh, Commonwealth of Pennsylvania, U.S.A., the sum of Thirty-three Thousand, One Hundred and Fifteen Dollars and Ninety-seven Cents ($33,115.97) held by the Minister of Finance pursuant to subsection 28(2) of the Public Trustee Act, together with interest in the amount of Two Thousand, Nine Hundred and Twenty-eight Dollars and Sixty Cents ($2,928.60), all respecting the Estate of Marzoa Shadroui, also known as Mary Nichols.

The Governor in Council on the report and recommendation of the Minister of Health dated January 17, 1996, pursuant to clauses (d) and (f) of subsection 16(1) of Chapter 197 of the Revised Statutes of Nova Scotia, 1989, the Health Services and Insurance Act, and in accordance with the Department of Health Construction Grant Program, is pleased to approve the making of a grant by the Minister of Health on behalf of the Province to the Victoria General Hospital site of the Queen Elizabeth II Health Services Centre, in a total amount not to exceed $2,360,000.00 (two million, three hundred and sixty thousand dollars) to cover 100% (one hundred per cent) of the cost of renovations required to complete air quality work at the hospital, which grant is to be paid on the basis of invoiced costs submitted to the Department of Health and charged to Capital Account, for the vote "Capital Grants, Capital Construction Projects", under the heading "Capital Grants, Department of Health".

The Governor in Council on the report and recommendation of the Minister of Community Services dated January 16, 1996, pursuant to subsections 6(1) and (2) of Chapter 420 of the Revised Statutes of Nova Scotia, 1989, the Senior Citizens' Secretariat Act, is pleased to:
      (a) rescind, effective December 31, 1995, the appointment of Dr. F.R. MacKinnon as the Chief Administrative Officer of the Senior Citizens' Secretariat made by Order in Council 80-937, dated July 8, 1980;
      (b) appoint Brian Vandervaart of Dartmouth, Halifax County, as Chief Administrative Officer of the Senior Citizens' Secretariat for a term of office commencing February 5, 1996, and ending February 5, 1998, all dates inclusive;
      (c) order that the said Brian Vandervaart be paid an honorarium at the rate of $25,000.00 annually;
      (d) order that Brian Vandervaart be excluded from the definition of employee as defined in Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act; and
      (e) order that Brian Vandervaart be entitled to the following employee benefits:

(i)  medical benefits, the cost of which Mr. Vandervaart will contribute to bi-weekly at the family rate;
(ii)  vacation entitlement at the rate of 15 one-half days per fiscal year; and
(iii)  sick leave at the rate of 0.75 days per month to a maximum of 9 days per fiscal year which cannot be accumulated beyond a fiscal year.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated October 26, 1995, pursuant to Sections 2, 3, 4 and 5 of Chapter 222 of the Revised Statutes of Nova Scotia, 1989, the Industrial Development Act, is pleased to:
      (a) amend Order in Council 92-1288 dated December 22, 1992, which authorized financial assistance to Dynatek Automation Systems Inc. of Bedford, Halifax County, by way of a purchase of preferred shares for an amount not exceeding Four Million Dollars ($4,000,000.00) on the terms and conditions contained in Schedule "A" approved thereby, by deleting in each of the 22nd and 25th lines on the third page of said Schedule "A" the word and numbers "March 31, 1997" and substituting therefor the word and numbers "March 31, 2002"; and
      (b) authorize the Nova Scotia Business Development Corporation to execute such agreements and other instruments as may be required to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency to the Minister of Finance dated October 26, 1995, pursuant to Sections 2, 9, 13, 16 and 17 of Chapter 49 of the Revised Statutes of Nova Scotia, 1989, as amended, the Business Development Corporation Act, and on the report and recommendation of the Minister of Finance dated October 26, 1995, pursuant to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) authorize financial assistance to Dynatek Automation Systems Inc. of Bedford, Halifax County, by way of an Ultimate Guarantee to the Royal Bank, in such form as the Attorney General may approve, in an amount not to exceed Four Million Dollars ($4,000,000.00), in support of an operating line of credit of not less than Four Million Dollars ($4,000,000.00), on the terms and conditions as set out in Schedule "B" attached to and forming part of the report and recommendation; and
      (b) authorize the Nova Scotia Business Development Corporation to execute the said Guarantee and such other agreements and instruments as may be required to give effect to this Order.

      (a) approve of the amendments to the Board Public Passenger Motor Carrier Act Regulations made by the Nova Scotia Utility and Review Board and approved by the Governor in Council by Order in Council 92-1257, dated December 22, 1992, made by the Nova Scotia Utility and Review Board in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation; and

The Governor in Council on the report and recommendation of the Minister of Justice dated February 1, 1996, and pursuant to subsections 2(1) and (2) of Chapter 104 of the Revised Statutes of Nova Scotia, 1989, the Costs and Fees Act, is pleased to amend item (17) under the heading "Fees to be taken at the Department of the Attorney General" of the Schedule to Part I of the Act in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation, for the purpose of increasing the fee for a commission for Queen's Counsel.

The Governor in Council on the report and recommendation of the Minister of Education and Culture dated January 26, 1996 and pursuant to Section 7 of Chapter 1 of the Acts of 1995-96, the Education Act, is pleased to:
      (a) designate as a school region the geographic area comprised of the school districts in which public schools are administered by the following district school boards:

  (i)  Inverness District School Board;
 (ii)  Richmond District School Board;
(iii)  Antigonish District School Board;
(iv)  Guysborough County District School Board;

      (b) establish a regional school board to administer the public schools in the school region referred to in clause (a); and
      (c) determine that the regional school board referred to in clause (b) be designated by the name "Strait Regional School Board".

The Governor in Council on the report and recommendation of the Minister of Health dated January 26, 1996, pursuant to Section 86 of Chapter 10 of the Acts of 1995-96, the Medical Act, is pleased to order and declare by proclamation that Chapter 10 of the Acts of 1995-96, the Medical Act, do come into force on and not before February 13, 1996.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated February 7, 1996, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a lease by the Minister of Natural Resources of a parcel of Crown land containing 3,218 square feet [299 square metres], more or less, the exact location and acreage to be determined by survey, situate at Eastern Passage, Halifax County, and shown outlined in red on the plan marked Schedule "A" attached hereto and forming part of the report and recommendation to W. Eddy Investments Limited, a body corporate with its Head Office at Eastern Passage, Halifax County, for the purpose of developing, maintaining and operating a lobster pound, gift shop, ferry service office and a beverage room and grill, with associated buildings only and for no other purpose, for a term of ten (10) years at an annual rent of $0.14 per square foot [$1.507 per square metre], with the right to renew the lease for a further ten (10) year term at a rent to be fixed by the Lessor, provided that the Lessee has satisfactorily complied with the terms and conditions of the lease.

The Governor in Council on the report and recommendation of the Minister of Agriculture and Marketing dated January 23,1996, pursuant to Sections 9 and 11 of Chapter 308 of the Revised Statutes of Nova Scotia, 1989, the Natural Products Act, is pleased to approve amendments to the regulations approved by Order in Council 84-813, dated July 17, 1984, made by the Nova Scotia Chicken Marketing Board and approved by the Natural Products Marketing Council in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated January 3, 1996, pursuant to subsections 22(2) and 22(3) of Chapter 18 of the Statutes of Nova Scotia, 1990, the Mineral Resources Act, and pursuant to subsection 16(1) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to:
      (a) authorize the Minister of Natural Resources to grant a special lease for coal lying on surface to 400 feet [122 metres] vertical to Pioneer Coal Limited substantially in the form of and subject to the terms and conditions contained in the special lease attached to and forming part of the report and recommendation as Appendix "A";
      (b) authorize the Minister of Natural Resources to issue to Pioneer Coal Limited, its successors and assigns, for a term to run concurrently with the term of the special lease for coal, a lease of Crown land located at Stellarton, Pictou County, more particularly shown on Appendix "B" attached hereto and forming part of the report and recommendation, containing approximately 180 acres [about 73 hectares], in consideration of payment of a lump sum of $50,000 at the time of signing, together with a Crown land rental of $1.50 per metric tonne of coal produced, payable quarterly, to an aggregate maximum Crown land rental of $2,000,000 and such other terms and conditions as the Minister may deem appropriate; and
      (c) authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purpose of this Order.

The Governor in Council on the report and recommendation of the Minister of Housing and Consumer Affairs dated February 6, 1996, pursuant to Section 3 of Chapter 94 of the Revised Statutes of Nova Scotia, 1989, the Consumer Services Act, and Section 17 of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to, effective May 26, 1995, revoke the appointment of Bob Martin as Director of Consumer Services and appoint Barbara Jones Gordon as Director of Consumer Services, effective on, from and after May 26, 1995.

      To be Acting Minister of Education and Culture from 7:15 p.m., February 27, 1996, to 1:30 p.m., March 1, 1996: the Honourable Richard Mann;
      To be Acting Minister of Natural Resources and Acting Minister responsible for the Tidal Power Corporation Act from 8:15 a.m., to 5:45 p.m., Tuesday, February 20, 1996: the Honourable Guy Brown;
      To be Acting Minister of Fisheries from 7:00 a.m., Tuesday, March 12, 1996, to 10:00 p.m., Thursday, March 14, 1996: the Honourable Wayne Adams;
      To be Acting Minister responsible for the Nova Scotia Economic Renewal Agency and to be responsible for any and all other duties assigned to that Minister from 10:45 a.m., until 7:30 p.m., Monday, February 26, 1996: the Honourable Bernard Boudreau.
