Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s.  The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population.  As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent.  For example, 44 feet 11 inches [13.69 metres].

It should be understood that these insertions are not part of the original text.
Any errors in these conversions are my responsibility.

The Governor in Council on the report and recommendation of the Minister of Justice and Attorney General dated December 7, 1995, pursuant to the Notaries and Commissioners Act, is pleased to:
      (a) revoke the appointment of Stephanie Smith of Liverpool, Queens County, as a Commissioner for taking affidavits, which appointment was made by Order in Council 92-956, dated September 22, 1992, while employed with the Municipality of the County of Queens; and
      (b) appoint Stephanie Nickerson of Liverpool, Queens County, as a Commissioner for taking affidavits, while employed with the Municipality of the County of Queens.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated December 1, 1995, to the Minister of Finance pursuant to Sections 2, 9, 13, 16 and 17 of Chapter 49 of the Revised Statutes of Nova Scotia, 1989, as amended, the Business Development Corporation Act, and on the report and recommendation of the Minister of Finance dated December 8, 1995, pursuant to Section 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to:
      (a) amend Order in Council 90-1484, dated December 20, 1990, as amended by Order in Council 91-1489, dated December 18, 1991, and as further amended by Order in Council 92-1241, dated December 15, 1992, and as further amended by Order in Council 95-439, dated June 6, 1995, which authorized assistance to Seagull Pewter and Silversmiths Limited of Pugwash, Cumberland County, by way of a guarantee to a Chartered Bank, in an amount not to exceed Two Million Dollars ($2,000,000.00), by deleting Schedule "A", which formed part of the Report and Recommendation, and substituting therefor the Schedule "A" attached to and forming part of the Report and Recommendation of the Minister of Finance dated December 8, 1995; and
      (b) authorize the Nova Scotia Business Development Corporation to execute such agreements and instruments as may be required to give effect to this Order.

The Governor in Council on the joint report and recommendation of the Minister of Education and Culture, and the Minister of Supply and Services dated December 20, 1995, pursuant to subsection 4(1) of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, and subsections 11(1) and (2) of Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to assign administration and control of the University College of Cape Breton campus property located at Sydney, Cape Breton County, more particularly described in Schedule "A" attached to and forming part of the Report and Recommendation from the Minister of Supply and Services to the Minister of Education and Culture, and to authorize the Minister of Education and Culture to arrange a survey of this property and then transfer it to the Board of Directors of the University College of Cape Breton at no charge upon such terms and conditions as are satisfactory to the Minister of Education and Culture.

The Governor in Council on the report and recommendation of the Acting Minister of Transportation and Communications dated December 5, 1995, pursuant to Section 18 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to:
      (a) extinguish the right of the public to use that portion of the public highway system containing 372 square meters (sic), more or less, situate at or near Porters Lake, Halifax County, and more particularly described in Schedule "A" which is attached to and forming part of the report and recommendation;
      (b) convey the said lands to Kenneth Richard King and Sonja Beverley King of Dartmouth, Halifax County, for the price of $250.00; and
      (c) authorize the Minister of Transportation and Communications to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Agriculture and Marketing dated November 30, 1995, and pursuant to Section 3 of Chapter 262 of the Revised Statutes of Nova Scotia, 1989, the Livestock Health Services Act, is pleased to:
      (1) revoke the appointment of John Redden of Truro, Colchester County, as a member of the Livestock Health Services Advisory Body, which appointment was made by Order in Council 94-787, dated September 27, 1994; and
      (2) appoint George Smith of Truro, Colchester County, as a member of the Livestock Health Services Advisory Body for a term of office commencing December 1, 1995, and ending November 30, 1997.

The Governor in Council on the report and recommendation of the Minister of Labour dated December 11, 1995, pursuant to Section 52 of Chapter 320 of the Revised Statutes of Nova Scotia, 1989, the Occupational Health and Safety Act, is pleased to amend the General Blasting Regulations made by Order in Council 90-195, dated February 20, 1990, in the manner set forth in Schedule "A" attached to and forming part of the Report and Recommendation, effective on, from and after January 3, 1996.

The Governor in Council on the report and recommendation of the Minister of Labour dated December 5, 1995, pursuant to Section 52 of Chapter 320 of the Revised Statutes of Nova Scotia, 1989, the Occupational Health and Safety Act, is pleased to:
      (a) make regulations respecting Fall Protection and Scaffolding in the form set forth in Schedule "A" attached to and forming part of the Report and Recommendation, effective on, from and after January 3, 1996;
      (b) adopt the Construction Safety Regulations made by Order in Council 68-104, dated February 12, 1968, pursuant to Chapter 152 of the Revised Statutes of Nova Scotia, 1967, the Construction Safety Act, as regulations under Section 52 of the Revised Statutes of Nova Scotia, 1989, the Occupational Health and Safety Act, with such changes as the circumstances may require;
      (c) amend the Construction Safety Regulations in the manner set forth in Schedule "B" attached to and forming part of the Report and Recommendation, the amendments to be effective on, from and after January 3, 1996; and
      (d) amend the Industrial Safety Regulations adopted by Order in Council 94-403, dated May 10, 1994, as regulations under Section 52 of Chapter 320 of the Revised Statutes of Nova Scotia, 1989, the Occupational Health and Safety Act, in the manner set forth in Schedule "C" attached to and forming part of the Report and Recommendation, the amendments to be effective on, from and after January 3, 1996.

      (b) convey the said lands to Courtney W. Porter and Ada A. Porter of Dort's Cove, Guysborough County, for the price of $345.00; and
      (c) authorize the Minister of Transportation and Communications to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 12, 1995, pursuant to subsection 18(1) and clause 19(f) of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to amend Order in Council 95-61, made January 24, 1995, appointing Daniel J. Graham of Halifax, Halifax County, as a provincial civil service member of the Canada-Nova Scotia Offshore Petroleum Board, by striking out the words "one year" from the sixth line and substituting therefor "six years".

The Governor in Council on the report and recommendation of the Minister of Justice dated January 4, 1996, pursuant to Section 6 of Chapter 11 of the Acts of 1992, the Utility and Review Board Act, as amended, and Section 18 of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to designate Linda Garber of Halifax, Halifax County, as Acting Chair of the Nova Scotia Utility and Review Board, to execute the office and functions of the Chair of the Board, and charge Linda Garber with the execution of the powers and duties of the office of Chair of the Board, for a term of office ending upon the designation of the Chair of the Board or revocation of this Order.

      (a) L'Ardoise School Council for L'Ardoise School administered by the Richmond District School Board;
      (b) the Digby Neck School Council for Digby Neck Consolidated School administered by the Digby District School Board;
      (c) the E.B. Chandler School Council for E.B. Chandler Junior High School administered by the Cumberland District School Board, and transfer those responsibilities of the Cumberland District School Board respecting the suspension of students as specified in subsection 39(3), the Education Act, to the E.B. The Governor in Council on the report and recommendation of the Minister of Transportation and Communications dated January 8, 1996, pursuant to Section 80 of Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to:
      (a) dispose of certain lands containing 0.52 hectare, more or less, situate at or near Ingonish Marsh, Colchester County, and more particularly described in Schedule "A" attached to and forming part of the report and recommendation;
      (b) convey the said lands to Twin Lanes Farm Limited of Belmont, Colchester County, in exchange for other lands used for highway purposes; and

The Governor in Council on the report and recommendation of the Minister of Justice dated January 5, 1996, pursuant to Sections 5 and 7 of Chapter 11 of the Acts of 1992, the Utility and Review Board Act, is pleased to, effective January 24, 1996, reappoint Darce Fardy of Halifax, Halifax County, to be a part-time member of the Nova Scotia Utility and Review Board for a term of office of one year, and determine his remuneration to be $150.00 per day for his services as a part-time member of the Board.

The Governor in Council on the report and recommendation of the Minister of Justice dated January 10, 1996, pursuant to Sections 5 and 7 of Chapter 11 of the Acts of 1992, as amended, the Utility and Review Board Act, is pleased to, effective January1, 1996, amend Order in Council 95-469 dated June 27, 1995, as amended by Order in Council 95-593 dated August 9, 1995, regarding the appointment of William J. Skinner as a part-time member of the Nova Scotia Utility and Review Board, by:
      (a) striking out "December 31, 1995" in the third line of paragraph (a) and substituting "December 31, 1997";
      (b) striking out "January 1, 1996" in line five of paragraph (b) and substitututing "January 1, 1998".

The Governor in Council on the report and recommendation of the Minister of Justice dated January 5, 1996, pursuant to Section 33 of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, is pleased to, effective January 24, 1996, redesignate Darce Fardy of Halifax, Halifax County, a member of the Nova Scotia Utility and Review Board, as a review officer for a term of one year for the purpose of conducting reviews pursuant to Section 32 of the Freedom of Information and Protection of Privacy Act.

The Governor in Council on the report and recommendation of the Minister of Justice dated January 5, 1996, pursuant to Sections 3 and 4 of Chapter 252 of the Revised Statutes of Nova Scotia, 1989, the Legal Aid Act, is pleased to, effective January 15, 1996:
      (a) appoint the following persons as Directors of the Nova Scotia Legal Aid Commission for a term of three years:

  (i)  Linda Borden of Halifax, Halifax County;
 (ii)  Faye MacLean of St. Peter's, Richmond County;
(iii)  Denise Boudreau of Port Hawkesbury, Richmond County;
(iv)  Heidi Marshall of Sydney, Cape Breton County; and
 (v)  Glen McDougall of Sydney, Cape Breton County;

      (b) appoint Glen McDougall of Sydney, Cape Breton County, as Chair of the Nova Scotia Legal Aid Commission for a term of three years.

The Governor in Council on the report and recommendation of the Minister of Justice dated January 12, 1996, and pursuant to Sections 672.38, 672.39 and 672.40 of Chapter C-46 of the Revised Statutes of Canada, 1985, the Criminal Code, is pleased to:
      (a) reappoint David J. Almon of Halifax, Halifax County, as a member of the Review Board for a term of three years commencing February 4, 1996;
      (b) reappoint Harry Poulos of Dartmouth, Halifax County, and Louise Cloutier of Dartmouth, Halifax County, as members of the Review Board, each for a term of two years commencing February 4, 1996;
      (c) reappoint Judith Hammerling Gold, C.M., M.D., of Halifax, Halifax County, as a member of the Review Board for a term of two years commencing March 4, 1996;
      (d) appoint Robert C. Stewart of Berwick, Kings County, as a member of the Review Board for a term of two years commencing February 4, 1996;
      (e) designate David J. Almon as Chairperson of the Review Board; and
      (f) determine the remuneration for the Chairperson to be at the rate of $100.00 per hour, not exceeding $3,300.00 per month, and for Harry Poulos, Louise Cloutier, Judith Hammerling Gold and Robert C. Stewart to be at the rate of $75.00 per hour.

      (a) appoint M. Heather Robertson, Q.C. of Halifax, Halifax County, as a full-time member of the Nova Scotia Utility and Review Board effective February 1, 1996;
      (b) appoint John A. Morash of Halifax, Halifax County, as a full-time member of the Nova Scotia Utility and Review Board effective March 1, 1996;
      (c) designate M. Heather Robertson, Q.C. as Chair of the Nova Scotia Utility and Review Board; and
      (d) determine the remuneration to be paid to M. Heather Robertson, Q.C. to be $81,121.93 per annum and the remuneration to be paid to John A. Morash to be $73,708.00 per annum.
